In pursuance to order dated 17.02.2021, a report was transmitted by the learned court below, which is kept at Flag 'X', whereby the Additional Sessions Judge-2nd, Muzaffarpur has reported that earlier the petitioner had been granted anticipatory bail by this Hon'ble Court, vide order dated 20.07.2020, passed in Cr. Misc. No. 21008 of 2020 when the bail bond was to be furnished by the petitioner in the event of surrender or arrest within a period of one month, but neither the petitioner surrendered within the stipulated period before the court below nor he furnished the bail bond. Thereafter, on 25.08.2020, the petitioner was arrested and produced before the learned Court when the petitioner was granted regular bail on the ground that the petitioner was already granted anticipatory

Patna High Court CR. MISC. No.39822 of 2020(3) dt.18-03-2021 2/2 bail by this Hon'ble Court.

Since the petitioner has been granted regular bail by learned Court below itself, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, this application is dismissed as withdrawn.
