Learned counsel for the petitioner submits that under similar circumstances, this Court, in the writ proceedings arising out of CWJC No 19348 of 2015, has allowed the petitioners therein to make their individual claim before the Chief Engineer. As such, the petitioners pray that they will also make their individual claim before Chief Engineer, Irrigation Department, Aurangabad (respondent No 5) within three weeks from today staking their claim having regard to the fact that others engaged in DDT Chirkaw, who were also seasonal workers, have been considered for regularization. In case, such an application is filed by the petitioners, respondent No 5 would be obliged to consider petitioners' case on the basis of merits of their claim in light of the departmental circulars and parity with those similarly situated and pass a reasoned and speaking order within three months thereafter.
