The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per the prosecution case, the accused persons including petitioner obstructed the informant in constructing his house and on protest, petitioner gave iron rod blow on the head of informant causing injury.

It is submitted on behalf of petitioner that there is case & counter case. Due to previous enmity, a simple Maarpit took place between the parties. The doctor has found the injury, sustained by the informant, to be simple in nature. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

No.55248 of 2021(3) dt.25-07-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S. Case No. 205 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
