====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2023 Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

It has been submitted by learned counsel for the petitioners that the petitioner no. 4, namely, Nirbhay Kumar Singh, has died as mentioned in paragraph nos. 1 and 4 of the modification application. Hence, he wants to withdraw the present modification application on behalf of petitioner no. 4, namely, Nirbhay Kumar Singh, in connection with Lalganj P.S.

Patna High Court CR. MISC. No.8657 of 2023(2) dt.08-02-2023 2/3 Case No. 220 of 2016 pending in the court of learned C.J.M., Hajipur.

Accordingly, the present modification application on behalf of petitioner no. 4, namely, Nirbhay Kumar Singh, is dismissed as withdrawn.

Heard learned counsel for the petitioner nos. 1 to 3 and learned A.P.P. for the State.

The present application has been filed for modification of the order dated 25.10.2018, passed in Cr. Misc. No. 64876 of 2018, by which the petitioner nos. 1 to 3 were granted anticipatory bail in connection with Lalganj P.S. Case No. 220 of 2016, pending in the court of learned C.J.M. Hajipur, and they were directed to surrender in the court below within a period of six weeks.

Learned counsel for the petitioner nos. 1 to 3 submits that due to some unavoidable reasons they could not surrender in the court below well within time. It is further submitted that further time may be extended so that they could surrender in the court below.

Considering the submissions made on behalf of learned counsel for the petitioner nos. 1 to 3 and the grounds mentioned in the modification application, the period of

No.8657 of 2023(2) dt.08-02-2023 3/3 surrender of the petitioner nos. 1 to 3 in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same. The order dated 25.10.2018, passed in Cr. Misc. No. 64876 of 2018, is modified to the extent as indicated above. The present application is disposed of.
