The petitioner is apprehending his arrest in connection with Telhara P.S. Case No. 02 of 2017 registered for the offences punishable under Sections 302, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he was present at the time occurrence and specific allegation of firing is against co-accused.

It has been submitted on behalf of the petitioner that there is no specific overt act alleged against the petitioner and he is made accused in this case as he is cousin of co-accused Gowardhan Bind.

Heard learned APP also, who could not controvert the

Having heard both sides and considering the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Telhara P.S. Case No. 02 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness or tamper with the evidence.
