JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2017 The petitioners are apprehending their arrest in connection with Ekma P.S. Case No. 188 of 2016, registered for offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that petitioner no. 1 happens to be the brother-in-law of the informant and petitioner no. 2 happens to be the sister of the informant and so far as allegations against petitioner no. 2 is concerned, they are only general and omnibus and as regards petitioner no. 1, though it is alleged that he tried to strangulate the informant, however no injury caused to him and another co-accused person having similar allegation has already been granted the privilege of anticipatory bail by this Court vide order dated 16.01.2017, passed in Criminal
Patna High Court Cr.Misc. No.6262 of 2017 (2) dt.20-02-2017 2/3 Miscellaneous No. 1135 of 2017.

Having heard both sides, in view of the fact that only general and omnibus allegations have been levelled against petitioners and they have no criminal antecedent and also on coaccused of this case, having similar allegation has already been granted anticipatory bail, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra, in connection with Ekma P.S. Case No. 188 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners shall cooperate in the investigation and make themselves available as and when required by the police and on
Patna High Court Cr.Misc. No.6262 of 2017 (2) dt.20-02-2017 3/3 the event of failure on their part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
