JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioners and the learned counsel for the State.

This application has been filed by the petitioners for modification in the order dated 18.10.2016 passed in Criminal Misc. No. 43605 of 2016 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that vide order dated 18.10.2016 passed in Criminal Misc. No. 43605 of 2016, the petitioners were granted anticipatory bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj, in connection with Dehri (T) P.S. Case No. 239 of 2016, subject to

Patna High Court Cr.Misc. No.18502 of 2017 (2) dt.26-04-2017 the conditions laid down under Section 438(2) Cr.P.C. But the petitioner could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioner prays for extension of period of surrender of the petitioner in the court below.

Considering the submission of the learned counsel for the petitioner, the period of surrender of the petitioner in connection with the aforesaid case in the court below is further extended for three weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 18.10.2016 passed in Criminal Misc.
