JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-03-2017 The petitioner is apprehending his arrest in connection with Puraini P.S. Case No. 77 of 2015, registered for offences punishable under Sections 147, 149, 341, 323, 307, 504 and 506 of Indian Penal Code.

From perusal of the record it appears that earlier also the petitioner had approached this court for grant of anticipatory bail, which was dismissed by a Co-ordinate Bench of this Court vide order dated 06.10.2016, passed in Criminal Miscellaneous No. 43229 of 2016 and again the petitioner has moved before this Court stating that some new facts has emerged and due to which the petitioner did not surrender. However, during course of argument, learned counsel for the petitioner could not point out any new glaring facts, which makes him entitled for grant of privilege of anticipatory bail. Patna High Court Cr.Misc. No.7565 of 2017 (3) dt.17-03-2017 2/2 bail of the petitioner is again rejected.

However, if the petitioner surrenders before the Court below and make prayer for regular bail and if any such application is filed, the same will be considered by the court below on the merit of the case without being prejudiced by the order of this Court.
