The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. The allegation against the petitioner along with other accused persons is of selling the stolen motorcycle. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case on the basis of confessional statement of co-accused Radhey Shayam and during checking by the police party, the said co-accused did not produce any document of the said motorcycle. There is no any incriminating articles has been recovered from the possession of the petitioner. The petitioner is languishing in
Patna High Court CR. MISC. No.39968 of 2020(3) dt.22-03-2021 2/2 judicial custody since 10.06.2020. Earlier, the petitioner has got two criminal antecedent which is mentioned in para 3 of the bail petition.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Rajeev Nagar P.S. Case No. 121/2020 to the satisfaction of learned Court below where the case is pending.
