This application, for grant of anticipatory bail, arises out of Kuchaikot Police Station Case No. 130 of 2019, disclosing offence under Section 360 of the Indian Penal Code. The allegation against the petitioner is that the petitioner has abetted the commission of suicide by the husband of the informant.

Learned Counsel for the petitioner submits that the petitioner is the wife of the brother of the deceased, who has committed suicide and there was family dispute with regard to some money allegedly taken by the petitioner from the deceased. He submits that both, the husband of the petitioner as well as husband of the informant, were working in Dubai and the petitioner has got no role to play in the commission of suicide by the husband of the informant.

No.43410 of 2019(2) dt.17-07-2019 2/2 After having heard learned Counsel for the parties and taking into consideration the fact that there is no suicidal note found at the place of occurrence and the parties appear to be related to each other, I find it a fit case for grant of privilege of anticipatory bail. Accordingly, this application is allowed. Let the petitioner, Urmila Devi, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikot Police Station Case No. 130 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
