JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-02-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 12.01.2021, within four weeks of starting of the Court proceeding in physical mode properly. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.
The petitioners seek bail in connection with S. Tr. No. 447 of 2019, arising out of Taraiya P.S. Case No. 84 of 2019, registered under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code.
Submission is that earlier the prayer of bail of the petitioners was refused on 18.02.2020 vide Cr. Misc. No. 68592
Patna High Court CR. MISC. No.3895 of 2021(2) dt.17-02-2021 2/2 of 2019 on merit with observation that the petitioners would be at liberty to renew their prayer for bail after six months. About one year has already been elapsed after passing of the order, dated 18.02.2020.
Having regard to the facts and circumstances of the case, let the petitioners, above named be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with S. Tr. No. 447 of 2019, arising out of Taraiya P.S. Case No. 84 of 2019 to the satisfaction of the Additional Sessions Judge, V, Saran at Chapra.
