====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-07-2021 Heard Mr. Iqbal Asif Niazi, the learned Advocate for the petitioners and Mr. Sucheta Yadav, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Keoti P. S. Case No.122 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 295(A), 379, 427, 153(A), 353 of the Indian Penal Code. The subject F.I.R. has been lodged by the Circle Officer alleging that there was scuffle between the members of two religious communities and in the ensuing ruckus, shops and vehicles were damaged.

There is no specific accusation against the petitioners.

No.41102 of 2020(3) dt.26-07-2021 2/2 In the dispute between the two communities, some clash took place and the name of the petitioners and accused persons of both sides were supplied by the opposite camps. In view of the aforesaid and there being no specific accusation against the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Smt. Smita Kumari, learned Judicial Magistrate, 1st Class, Darbhanga in connection with Keoti P. S. Case No.122 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

While saying so, the Court has also taken note of the fact that the petitioners do not have criminal antecedents. The application stands allowed.
