JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioners and the learned APP for the State, through Video Conferencing. The petitioners seek bail in connection with Manigachhi P.S. Case No. 158 of 2021, instituted for the offences under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioners submits that the petitioners are in custody since 13.07.2021, are a person with clean antecedent, charge-sheet has been submitted in this case and allegation is of recovery of 492.810 litres of liquor from an Asbestus room of petitioner No.1.

The learned counsel for the petitioner submits that the

Learned A.P.P. opposes the bail application.

Considering the fact that petitioners are in custody since 13.07.2021, are a person with clean antecedent, chargesheet has been submitted, the petitioners, above-named, are directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Manigachhi P.S. Case No. 158 of 2021.

The application stands allowed.
