1. Heard learned counsel for the petitioner, Ms. Varsha Rani and learned A.P.P. for the State. 2.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2),115(2), 117(2), 109(1), 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the petitioners submits that petitioner are persons with clean antecedent and the informant alleges that on 05.05.2026 at 06:00 AM, when he came out of the house, six named accused persons including the petitioners came and Md. Saddam asked his brothers to bring farsa for killing him, thereafter Md Saddam assaulted by farsa causing

Nabi by farsa causing injury on head and also cut his hand, thereafter woman accused entered his house and assaulted his wife, daughter-inlaw and maternal grand daughter aged about nine years, thereafter accused persons took away jewelry as detailed in the FIR.

Learned counsel appearing on behalf of the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to water logging, it is next submitted that informant and the petitioners are brothers and are also having dispute relating to property, it is further submitted that specific allegation of assault is against Md. Saddam and Md. Salamat and as far as petitioners are concerned, no specific allegation of assault is alleged against the petitioners and petitioners are not criminals. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties

Case No. 124 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
