JUSTICE RAKESH KUMAR ORAL ORDER 26-06-2018 Heard Sri Tribhuwan Narayan, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Durgawati P.S. Case No.127 of 2018 registered for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

Learned counsel for the petitioner submits that the petitioner has falsely been made accused on an allegation as if the petitioner was selling liquor, however nothing was recovered from the conscious possession of the petitioner. In the present case, the police has shown recovery of about 6 liters 840 ml from a bush, situated behind the house of his brother and the

Patna High Court Cr.Misc. No.29261 of 2018(3) dt.26-06-2018 2/2 petitioner has been made accused. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent.

Considering the fact that the petitioner is having clean antecedent and nothing was recovered from the conscious possession of the petitioner, in the event of his arrest or surrender within six weeks from today, let the petitioner, namely, Pullu Ram be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.IV-cum-Special Judge, Kaimur at Bhabua in connection with Durgawati P.S. Case No.127 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) nawalkrs/- U T
