The petitioner has renewed his prayer for bail in connection with Bahadurpur P.S. Case No. 236 of 2020 registered under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016. His prayer for bail was earlier rejected by this Court vide order dated 05.12.2020 passed in Cr.Misc. No. 31941 of 2020 considering the recovery of 85 cartons of illicit liquor from the truck being driven by the petitioner.

It is submitted by the learned counsel for the petitioner that though the petitioner is in custody since 05.06.2020, charges have not been framed after taking cognizance of the offence.

Considering the nature of the offence, the allegation made against the petitioner, the period undergone by the petitioner in custody as an under-trial prisoner and the unlikelihood of the trial coming to an end in near future, I am inclined to grant bail. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cumSpecial Judge (Excise), Darbhanga in connection with Bahadurpur P.S. Case No. 236 of 2020.
