2. Lastly, the prayer for bail of the petitioner was rejected by this Court vide order dated 17.05.2023 passed in Cr. Misc. No. 16357 of 2023.

3. Learned counsel for the petitioner submits that the report of Trial Court dated 28.09.2024 reveals that charge has already been framed and the case is pending for evidence. Summon has been issued to witnesses but till date no prosecution witnesses has been examined. Further submission is that petitioner is in custody since 09.08.2021 and there is no likelihood of conclusion of the trial in near future.

4. Having considered the period of custody of the petitioner and tardy progress of the trial, let the petitioner above

Patna High Court CR. MISC. No.48138 of 2024(3) dt.18-10-2024 2/2 named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 446 of 2021.
