Heard Mr. Ajay Kumar Singh, learned counsel for the petitioner, Mr. Vijay Shankar Shrivastava, learned counsel for the opposite party no. 2 and learned APP for the State. Today, in compliance of the order of this Court, the husband is present physically, however, the wife is not present. Though, there was specific direction of this Court for her presence.
The prosecution case is based upon a written
Patna High Court CR. MISC. No.55250 of 2021(5) dt.20-09-2022 2/2 complaint, wherein the allegation of torture has been made by the opposite party No. 2 for demand of dowry etc. Considering the submissions made on behalf of the petitioner that he is still ready to keep his wife with honour and dignity and having found the chance of amicable settlement between the parties, this Court referred the matter to the Patna High Court Mediation Centre, after enlarging the petitioner on provisional bail vide order dated 05.04.2022. A report of mediator's has been received and the same is kept on record showing that the dispute between the parties has been resolved through the process of mediation and an agreement/settlement has drawn and signed by the parties. Considering the fact that the dispute has been resolved between the parties, the provisional bail granted to the petitioner vide order dated 05.04.2022 is hereby confirmed on the conditions mentioned therein.
