The petitioner has filed the instant application for grant of regular bail in connection with Ramgarh P.S. Case no. 175 of 2020 registered under section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on a raid being conducted while accused Amrit Kumar was arrested, it was disclosed by him that the accused who had managed to escape was the petitioner herein. It is stated that 13.4 litres of illicit liquor was recovered.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.41061 of 2020(2) dt.18-03-2021 2/2 that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has no criminal antecedent and is in custody since 30.8.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Ramgarh P.S. Case no. 175 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge 5th -cum- Special Judge, Excise, Kaimur (Bhabua).
