====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2018 Heard learned counsels for the petitioner and the respondent-State.

The present writ application has been filed for a direction to the respondents to supply a certified copy of sale deed executed with Dastawez No.6035, Zild-36, Page No.135136 of the year 1950 available in the office of Sub-Registrar, Sonepur, Saran and to take action against the officials of SubRegistrar office, Chapra for not supplying the instrument. It is submitted by learned counsel for the petitioner

Patna High Court CWJC No.10758 of 2016(2) dt.06-11-2018 2/3 that the petitioner filed Title Suit No. 157 of 2014 before the Court of learned Sub-Judge-II, Saran at Chapra with a prayer for restraining the defendants from interfering with the possession of the petitioner from the land appertaining to Khata No.3, Survey No.689, situated in Mauza-Kharika, District-Saran. In the said Title Suit, the defendant claimed the land in question by virtue of Dastawez No.6035, Zild-36, PageNo.135-36. The petitioner applied for a copy of the said deed, but the same was not supplied, upon which the petitioner sought an information under the Right to Information Act, whereupon, the petitioner was informed that the said deed is not available, when it is available, it will be supplied. Hence, the present writ application.

It is submitted by learned AC to SC-5 that efforts will be made to locate the deed in question and will be supplied to the petitioner within a time frame.

Considering the nature of prayer made, the Respondent No.2, the District Collector, Saran at Chapra is expected to look into the matter and issue necessary direction to the office of the Sub-Registrar, Saran for issuance of certified copy of the deed in question within a period of eight weeks and the copy of the deed in question be issued to the petitioner

Patna High Court CWJC No.10758 of 2016(2) dt.06-11-2018 3/3 within eight weeks thereafter.
