JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 363, 366(A) of Indian Penal Code.

As per prosecution case, this petitioner kidnapped the minor daughter of the informant for the purpose of marriage. Learned counsel for the petitioner submits that the victim in her statement recorded under Section 164 of Cr.P.C. has denied the prosecution case and stated that out of her own sweet will she married with the petitioner. She has disclosed her age as 20 years. Petitioner has got clean antecedent. Considering the statement of the victim recorded under Section 164 of Cr.P.C., let the above named petitioner in the event of his arrest/surrender before the court below within a

S. Case No. 104 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
