JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 23-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, office will place the matter before the Bench. The petitioner seeks bail in connection with Muffasil P.S. Case No.241 of 2020 registered for the offence punishable under Sections 307, 302, 34 of the Indian Penal Code and section 27 of the Arms Act.

As per allegation in the FIR, while the informant was coming back home along with his brother, the brother of the informant was shot dead by Ramnath Kumar and two other

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case and has not committed any offence as alleged in the FIR. It is submitted that petitioner is not named in the FIR and his name transpired in course of investigation in the confessional statement of the coaccused. There is no specific overt act against the petitioner. Similarly situated co-accused namely Vijay Kumar has been granted bail by a co-ordinate Bench of this Hon'ble Court in Cr. Misc. No.25719 of 2020 dated 12.11.2020. The petitioner has been named in one case after implication in the present case and has been languishing in custody since 29.05.2020. Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below in connection with Muffasil P.S. Case No.241 of 2020.
