The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 225 of 2021 registered under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to suspicion. There is general and omnibus allegation against the petitioner. Petitioner has no criminal history.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. The alleged

Patna High Court CR. MISC. No.55410 of 2021(2) dt.11-05-2022 2/2 recovery of arms has been made from the house of the petitioner. Hence, petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) utkarsh/- U T
