JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 Heard learned counsel for the petitioner and the State. Earlier the prayer for bail application of the petitioner was rejected vide order dated 20.01.2021 by a co-ordinate Bench of this Hon'ble Court.

It is submitted on behalf of the petitioner that after investigation Police submitted charge-sheet under Section 279, 304(a), 34 of the Indian Penal Code against the petitioner. It is further submitted that as per the FIR, petitioner is neither driver nor owner of the alleged tractor. He is only alleged to have given information to the informant about the death of his son. Petitioner has got clean antecedent.

Considering the aforesaid facts and changed circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty

Patna High Court CR. MISC. No.45586 of 2022(2) dt.06-12-2022 2/2 days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Mufassil P. S. Case No. 45 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
