1. Heard Mr. Sabal Kumar Jha, the learned Advocate for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Teghra P.S. Case No. 410/2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Mr. Jha, the learned Advocate for the petitioner points out that the co-accused Chandan Kumar on whose confession, the name of the petitioner transpired, has been granted bail by this Court vide order dated 03.03.2020 passed in Cr. Misc. No. 13279/2020.

4. 843 litres of liquor is said to have been

Patna High Court CR. MISC. No.50518 of 2024(2) dt.26-07-2024 2/2 intercepted, which was being carried in a Tata Magic vehicle. It later transpired that Chandan Kumar, the said co-accused had been dealing in liquor.

5. The petitioner, as noted above, has been named by the afore-noted Chandan Kumar.

6. Considering the fact that the petitioner has not yet surrendered to the process of law, I am not inclined to grant anticipatory bail to him.

7. The prayer is rejected.

8. However, if the petitioner surrenders before the court below within a period of four weeks, the court below shall consider the fact that the co-accused on whose confession, the petitioner has been made accused in this case, has been granted bail and shall pass orders in accordance with law without being prejudiced by the fact that the present anticipatory bail has not been entertained.
