1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Thakurganj Police Station Case No. 165 of 2023, disclosing offences under Sections 419, 420, 188, 304, 120(B), 34 of the Indian Penal Code.

3. As per the prosecution case, the informant reported that a woman named Sania Begam died on 16.06.2023 at Life Care Nursing Home, allegedly operating illegally in Thakurganj. Following a joint team inquiry, the District Magistrate, Kishanganj, directed the registration of an FIR against the nursing home's managers namely Md. Akram, Mahesh Kumar Ganesh and the petitioner, based on a report dated 05.07.2023.

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to local politics and ulterior motive of high handed persons of the locality. Petitioner was not arrested from the spot and nothing has been recovered anything recovered from his possession. Petitioner has been made accused solely based on the fact that he is the founder of the nursing home, with no direct allegations or evidence of involvement. There are no complaints from private individuals, including the deceased's husband, and the nursing home was operated under qualified medical supervision. There is no evidence suggesting the petitioner's participation or conspiracy in the alleged incident.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is named in the FIR, petitioner failed to show any document that the nursing home was registered or he was having any license, I am not inclined to grant the petitioner privilege of anticipatory bail.
