The petitioner seeks direction to the respondents for consideration of his case for appointment to the post of Constable pursuant to the selection process initiated vide Advertisement Nos.01 of 2004.

A counter affidavit is filed contesting the claim and paragraphs 5, 9 and 10 thereon puts the challenge to an end inasmuch as it is stated that though the petitioner could manage to get only 9 marks in physical test while the selection has been made to the candidates who have obtained 15 marks or above in the physical test. It is stated that since the petitioner has obtained less than 10 marks hence he was not selected.

Patna High Court CWJC No.6964 of 2016 dt.25-06-2018 Since it is the specific statement of the State that none of the candidates below 15 marks have been selected for appointment, there being no rejoinder to the counter affidavit contesting such claim, no cause for interference is made out nor any direction is needed.
