The petitioner seeks bail in Magadh Medical P.S. Case No. 77 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner is alleged to have fired upon the son of informant, as a result of which he died.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is case and counter case. The IO during investigation did not find any pellet empty or loaded at the place of occurrence. Petitioner is

Patna High Court CR. MISC. No.40510 of 2020(3) dt.23-03-2021 2/2 in custody since 24.05.2020.

Counsel for informant however, vehemently opposed the prayer for bail and submitted that petitioner is the main assailant and there is direct and specific allegation against him. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. Trial court is directed to expedite the trial and conclude the same as early as possible.
