2. Heard learned counsel for the appellant and the State.

This criminal appeal has been filed against the order dated 22.05.2024 passed by learned Exclusive Special Court (SC/ST) Act, Vaishali at Hajipur in ABP No. 1167 of 2024 in connection with Mahua P.S. Case No. 146 of 2024, instituted under Sections 147, 148, 149, 341, 323, 324, 307, 379, 325, 354(B), 427, 447, 504, 506 of the Indian Penal Code and Sections 3(i)(r)(s), 2(va), 3(1)w(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the
Patna High Court CR. APP (SJ) No.3077 of 2024(3) dt.16-10-2025 2/3 prayer for anticipatory bail of appellant has been rejected.

Prosecution case, in brief, is that on 25.03.2024 at about 21:50 PM, when informant was sitting with his nephew at the door, all the F.I.R. named accused persons, including this appellant, variously armed, came the abused informant by caste name and when informant protested, the accused persons assaulted them. It is further alleged that co-accused Rahul Singh assaulted on the head of informant with iron rod causing head injury and thereafter, other accused persons also assaulted him as a result his leg got fractured. Further allegation is that coaccused Rahul Kumar snatched 5,000/- from the pocket of informant.
5. Learned counsel for the appellant submits that appellant is innocent and has committed no offence. Both parties are co-villagers and due to petty dispute, simple quarrel took place between them. Specific accusation of assault is against co-accused Rahul Singh. So far this appellant is concerned, allegation against him is general and omnibus. Case and counter case. He further submits that the alleged offence was not committed only on the ground that the victim was member of SC/ST community and as such, no offence under SC/ST Act is made out against appellant. 6. Learned Spl. Public Prosecutor for the State opposed the bail application.
7. Considering the aforesaid facts, let the appellant, as named above, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court (SC/ST) Act, Vaishali at Hajipur in connection with Mahua P.S. Case No. 146 of 2024.
8. Accordingly, this criminal appeal is allowed and impugned order dated 22.05.2024 is set aside with respect to this appellant only.
