The petitioner apprehends his arrest in connection with Compliant Case No. 1368 of 2015, registered under Sections 323, 313, 511, 498(A) and 406 of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

The accusation is of torturing of complainant by her husband and other in-laws due to non-fulfillment of demand of dowry and also removed her from her matrimonial house. Learned counsel for the petitioner submits that petitioner wants to keep her wife (O.P. No.2) with full dignity and honour, but

Patna High Court Cr.Misc. No.5300 of 2017 (5) dt.01-07-2017 2/2 O.P No.2 is not ready to live with the petitioner. From perusal of the record it appears that notice has been received by O.P. No.2, but in spite of receiving of the notice, none appears on behalf of O.P. No.2.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Nawada in connection with Complaint Case No. 1368 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
