JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Islampur P.S. Case No. 19 of 2016 instituted for the offence under Sections 341, 323 and 354(B) of the Indian Penal Code.

Prayer for anticipatory bail of the petitioner was earlier rejected by this Court vide order dated 1.4.2016 passed in Cr. Misc. 13176 of 2016. This is second anticipatory bail application filed on behalf of the petitioner. The petitioner has submitted that there is no any evidence or statement of the witnesses in the case diary to support the case of the prosecution. These are the grounds for regular bail. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.16910 of 2017 (2) dt.09-05-2017 2/2 Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed of on its own merit without being prejudice by this order.
