The petitioner apprehends his arrest in Naya Ram Nagar (Safiyasaray) P. S. Case No. 131 of 2016 registered for the offence under Section 304 of the Indian Penal Code. The informant alleged that on 18.09.2016, his father was suffering from diarrhoea. The informant took his father to the clinic of Dr. Mithlesh Pathak, but his compounder Pappu Mandal (petitioner) gave some injection to his father and thereafter his father died.
Learned counsel for the petitioner submits that the petitioner is a compounder. He gave injection for the betterment of the patient, but it appears that the petitioner has got no certificate or degree to inject the patient, but he injected the father of
Patna High Court Cr.Misc. No.16302 of 2017 (2) dt.02-05-2017 2/2 the informant and immediately thereafter the father of the informant died.
Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the anticipatory bail application is rejected.
