The petitioner prays for anticipatory bail in connection Barun PS case no. 187 of 2016 registered for the offence punishable under sections 30(a), (c), (d), (e)/33, 34(b) of Bihar Prohibition and Excise Act, 2016.
It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner and his name transpires in the confessional statement of co-accused and the other accused from whose possession, recovery is made has already been granted bail by the lower court concerned itself. Heard learned A.P.P. also.

In view of Section 76(2) of Bihar Prohibition and Excise Act, 2016, his prayer for anticipatory bail is rejected. However, he may renew his prayer for bail before the learned court below and on the basis of the submissions made by the parties, lower court concerned may consider his prayer for regular bail and pass appropriate order without being prejudiced by the order of this Court. With these observations, this bail application is disposed of.
