JUSTICE SANJAY PRIYA ORAL ORDER 4/ 08-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Rampur P.S. Case No.162 of 2017 instituted for the offence under Section(s) 376, 506 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Gaya.

In the written report, it is alleged that this petitioner after entering into the house of the informant committed illegal act with her after tying both her hands and putting clothes in her mouth. The informant raised halla then nearby people arrived and this petitioner was caught by Mohalla people, but the petitioner gave threat to them.

The victim has given statement under Section 164

Patna High Court Cr.Misc. No.3552 of 2018 (4) dt.08-05-2018 2/2 Cr. P. C., wherein, she has supported the allegation against the petitioner.

Case diary has been received.

Learned Counsel for the State has submitted that witnesses have supported allegation against the petitioner. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
