The petitioner seeks bail in Sessions Trial No. 145 of 2019 arising out of Phulwarisharif P.S. Case No. 326 of 2018, instituted for the offence under Section(s) 341, 323, 307/34 of Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the written report.

It is alleged in the written report that son of the informant namely, Bishnu Kumar had gone to attend marriage function. The informant got information that his son has sustained firearm injury. His treatment is going on in Paras Hospital. The informant along with his elder son reached at Paras Hospital and found treatment of his son was going on. The

The Police during investigation has arrested coaccused Bittu Kumar @ Bittu Kumar Sharma and recorded his confessional statement. He disclosed the name of petitioner. Counsel for the petitioner submits that Bittu Kumar @ Bittu Sharma has already been granted bail by this Court vide order dated 30.1.2019 passed in Cr. Misc. 3665 of 2019. Petitioner is in custody since 12.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XV, Patna, in connection with Sessions Trial No. 145 of 2019 arising out of Phulwarisharif P.S.
