The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 354, 379 504, 506/34 of the Indian Penal Code.

As per the prosecution case, on 06.08.2021 at about 11:30 AM, while the husband of the informant was working with the labourer on his field, petitioners alongwith other FIR named accused came there and abused & assaulted him. It is further alleged that when informant came there to save her husband, she was also assaulted by accused persons and thereafter, petitioner no. 1 is alleged to have torn her blouse. The alleged occurrence took place due to land dispute between the parties.

No.57670 of 2021(2) dt.04-07-2022 2/2 Learned counsel for the petitioners submits that petitioners and husband of informant are own gotiyas and due to land dispute, the informant has instituted this false and fabricated case against petitioners and others. He further submits that prior to the present case, one more case was instituted against petitioners from the informant side, vide Tariyani P.S. Case No. 117 of 2021. As a matter of fact, some altercation took place between the parties due to land dispute and partition of property and thereafter, present false case was lodged against petitioners and others.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Sheohar in connection with Tariyani P.S. Case No. 187 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
