Petitioners apprehend their arrest in connection with Azamnagar P.S. Case No. 257 of 2017, registered for the offences punishable under Sections 323, 364, 347, 348 and 506 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping the nephew of the informant.

Submission of learned counsel for the petitioners is that they have implicated in this case only on the basis of suspicion and except that there is nothing against them. Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail,

Patna High Court Cr.Misc. No.14185 of 2018 (3) dt.09-05-2018 2/2 stating that paragraphs 5,6,7 and 8 of the case diary clearly show that petitioners have intention to grab the land of the informant and they have kept the boy and the boy is still traceless. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather the petitioners to surrender and make prayer for regular bail, which shall be considered on its own merit.
