1. Heard learned counsel for the petitioner Mr. Sanjeev Mishra and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 96 and 3(5) of the BNS.

3. The Investigating Officer of the case along with the victim are present in the Court in compliance of the order dated 15.07.2026.

4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her minor daughter aged about 17 years on 03.10.2025 was kidnapped by Rambilash along with petitioner and two unknown accused. Learned counsel for the petitioner

Patna High Court CR. MISC. No.45440 of 2026(3) dt.20-07-2026 2/3 submits that the case was taken up on 15.07.2026 when inadvertently it was submitted that petitioner married the victim, when brother of the petitioner namely Rambilash Paswan married the victim.

5. Learned A.P.P. for the State based on instruction of the Investigating Officer submits that victim had married Rambilash and is staying at her matrimonial home.

6. Learned Counsel appearing on behalf of the petitioner at this stage submits that petitioner being brother of Rambilash came to be implicated. It is also submitted that a supplementary affidavit on behalf of the petitioner has been filed bringing on record the fact that victim married Rambilash.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Laxmipur P.S. Case No. 262 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
