JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT Date: 28-08-2018 The counter affidavit file on behalf of respondent no.4 is containing only ornamental statements saying that the investigation of the case is properly going on.

2. This is a case under Section 304 (B) of the Indian Penal Code lodged as back as on 29.03.2016. In such cases, if the investigation has not been completed by the concerned Investigating Officer, who is incharge of the case, the Superintendent of Police, Chapra shall change the Investigating Officer immediately and ensure that proper steps are taken to complete the investigation of the case without further delay.

3. The writ application is presently being disposed of with a direction to the Superintendent of Police, Chapra to ensure completion of investigation and all such steps which are required to be taken to procure the attendance of the accused be taken within a period of three months from the date of receipt/production of a copy of this order. Merely by saying that steps are being taken towards proper investigation and then the steps are being taken to obtain the warrant of process under Section 82 Cr.P.C. he cannot absolve himself from the responsibility. Non-compliance with the order as aforesaid shall be viewed seriously.

3. This application stands disposed of.
