2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kesaria P.S. Case No. 567 of 2022 (G.R. Case No. 7037 of 2022) instituted for the offence under Sections 341, 323, 324, 307, 354, 379 and 504/34 of the Indian Penal Code (in short 'IPC').

The case of the prosecution is that the petitioner along with other co-accused came at the door of the informant riding on one bike and started abusing the son of the informant, namely, Sonu Dubey. All of a sudden, co-accused Munnu Dubey inflicted iron rod on the head of Sonu due to which he sustained injury on his elbow and waist. When the informant went to rescue her son, all three accused persons pulled her saree. It is also alleged that the petitioner assaulted the informant with lathi due to which she got injured.

4. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus and the injuries which has been received by the victims of this case are simple in nature. The petitioner is a man of clean antecedent.

5. Learned APP appearing for the State has conceded to the arguments of the learned counsel for the petitioner that the nature of allegation is general and omnibus.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kesariya P.S. Case No. 567 of 2022 (G.R. Case No. 7037 of 2022), he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. Accordingly, the present bail application stands allowed.
