The Petitioner apprehends his arrest in Lauriya P.S. Case No.80 of 2016 instituted for the offence under Section(s) 394 Indian Penal Code.

It has been submitted that the petitioner is not named in the First Information Report. There is no recovery from the possession of the petitioner. As per the allegation, when the informant was returning after withdrawing money from the bank, four miscreants had snatched his money near canal at the point of katta.

Learned APP has pointed out that name of this petitioner has come in para 57 of the case dairy on the basis of CCTV footage, wherein, it has been mentioned that spy has

Patna High Court Cr.Misc. No.3656 of 2017 (3) dt.23-02-2017 2/2 spoken about the suspicious activities of one Laddu Ansari and this petitioner, who is said to be member of the gang of said Laddu Ansari.

In this manner, besides suspicion there is nothing against this petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Lauriya P.S. Case No.80 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, subject to the conditions as laid down under Section 438(2) Cr. P. C.
