JUSTICE SANJAY PRIYA ORAL ORDER 3/ 29-06-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner apprehends her arrest in Sahebganj P.S. Case No. 291 of 2017 instituted for the offence under Section(s) 302/34 Indian Penal Code pending in the Court of Additional Chief Judicial Magistrate 1st West, Muzaffarpur. In the written report, it is alleged that mother-in-law caught hold Prem Sheela Devi (since deceased) and this petitioner along with co-accused Munna Ray assaulted her with iron rod on account of which she died on the spot. It is further alleged that deceased was pregnant.

Case diary has been received. The learned APP has submitted that in post mortem report two injuries were found and

Patna High Court Cr.Misc. No.29770 of 2018 (3) dt.29-06-2018 2/2 on dissection of chest and abdomen, abdominal cavity was found to be full of blood.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- Rohit Kr.
