2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 324, 341, 307, 354, 504, 506 and 379 of the Indian Penal Code.

3. It is alleged that all the accused persons including petitioners came upon the land of informant and assaulted him, his wife and other family members with iron rod, as a result of which the wife of informant got serious injury on her head.

4. It is submitted that admittedly there is dispute over the share in property between the parties. Both parties are own Gotias. Moreover, injury sustained by the injured is simple in nature. Petitioners claim clean antecedents.

5. Considering the backdrop in which the occurrence took place and nature of injury, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Ist-cum-Special Judge Kishanganj/concerned court in connection with Terhagachh P.S. Case No. 25 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
