2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 318 (4), 338, 336(3) and 340(2) of the Bharatiya Nyaya Sanhita, 2023 and sections 8(c), 21 (c) , 29 and 35 of the NDPS Act.
3. As per the prosecution case , 2880 piece of 100 ml each containing Codeine Phosphate and Triprolidine Hydro Choloride Syrup Onerex Cough syrup in cartoons were recovered from an e-rickshaw which was being driven by this petitioner who disclosed that the cartoons contained medical drugs and the same were going to be delivered to co-accused Kishor Kumar Mahto and he also gave the mobile phone number of co-accused Kishor Kumar Mahto .
4. It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.44364 of 2025(5) dt.31-10-2025 2/2 petitioner is owner-cum-driver of seized E-rickshaw . He was not aware of the nature of consignment. Petitioner claims clean antecedent and chargesheet has been submitted. Petitioner is in custody since 11.04.2025 .
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the nature of accusation and period of custody , prayer for bail of petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Sessions-Cum- Special Judge (NDPS Act ) Darbhanga in Mabbi Police Station Case No. 50 of 2025 .
