====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-02-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Bairgania P.S. Case No.236 of 2021 registered under Sections 341, 406, 420, 376, 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that no occurrence has taken place as alleged in the F.I.R.
Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that the petitioner is alleged to have committed breach of trust in respect of borrowed
Patna High Court CR. MISC. No.45567 of 2022(6) dt.06-02-2023 2/2 money as well as committing rape with the victim. It is further submitted that the petitioner has got five criminal antecedents. Therefore, the petitioner does not deserve anticipatory bail. Having considered the above facts and circumstances of the case as well as the nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
