JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-11-2018 This writ petition was filed on 04.05.2015 by the petitioner for a direction to the respondents to consider her case for compassionate appointment. Husband of the petitioner died in harness on 25.10.2011. Petitioner thereafter approached the respondents for consideration of her case for compassionate appointment.

On behalf of respondent stand has been taken in para7 and 8 to contend that the case of the petitioner for compassionate appointment is under consideration. The counter affidavit was filed on 22.9.2015. We are

Patna High Court CWJC No.7058 of 2015(2) dt.27-11-2018 2/2 in 2018. Neither petitioner nor respondents are in a position to apprise the Court about the latest position. The matter for compassionate appointment requires consideration in order to provide financial assistance to the family of the employee who died in harness so that family may tide over the financial crisis occasioned on account of death of bread earner. Considering the fact that respondents in the counter affidavit have admitted the fact that issue of compassionate appointment of the petitioner is under consideration, the respondents District Programme Officer (Establishment), Gaya and Municipal Commissioner, Gaya are hereby directed to consider the case of the petitioner for compassionate appointment at the earliest, if not already decided within a maximum period of four months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
