Mr. NITYANAND ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-09-2017 I have heard learned counsel for the petitioner and the State.
The petitioner apprehends his arrest in a case registered for offences punishable under Section 448, 324 and 307 of the Indian Penal Code.
As per allegation, petitioner gave several blows on the head of the informant. However, it is clear from the case diary as well as report of the concerned court and report of the Superintendent of Police, as appended, that there is no injury report. Thus, it is contended on behalf of the petitioner that since there is no injury report, allegation is not supported by any medical evidence.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.14376 of 2017(6) dt.19-09-2017 2/2 case, let the abovenamed petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Giriak P.S. Case No. 125/14, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
