The petitioner has filed the instant application for grant of regular bail in connection with Rauta P.S. Case No. 36 of 2020 registered under Sections 302, 120B and 34 of the Indian Penal Code.

Allegedly, it is a case of commission of murder of the informant's niece by her step-mother.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. She has falsely been implicated in this present case. It is a case of homicidal death. It is further submitted that there is no prior complaint against the petitioner that she used to torture the deceased and also no consistent material against her which

Patna High Court CR. MISC. No.46006 of 2022(4) dt.31-01-2023 2/2 shows that she committed the offence. After completion of the investigation, chargesheet has been submitted under Section 306 of Indian Penal Code. Petitioner is languishing in judicial custody since 29.04.2022.

The application for bail is vehemently opposed by learned APP for the State and submitted that the FSL report supported the prosecution case, and the Aluminium Phosphide (Celphos) is detected in FSL report which is highly poisonous. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Rauta P.S. Case No. 36 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea.
