====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 64 of the Bharatiya Nyaya Sanhita, 2023.

3. As per prosecution case, on 21.09.2024, the petitioner allegedly entered the victim's house while she was sleeping, gagged her with a cloth and tried to rape her. The victim's daughter woke up and raised an alarm, her in-laws awoke and tried to catch the petitioner, but he pushed them and fled away. During investigation, the victim in her statement under Section 183 of the B.N.S.S. has supported the prosecution case.

4. Considering the specific and direct nature of accusation and statement of the victim, the prayer for grant bail of to the petitioner is rejected.

5. However, considering the fact that the petitioner is in custody since 28.02.2025, the learned trial court is directed to expedite the trial and conclude the same, preferably within a period of one year from the date of receipt/production of copy of this order.
