2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Simri Bakhtiyarpur P.S. Case no. 23 of 2024 instituted for the offence under Sections 379, 341, 324, 307, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that on 21.01.2024, the informant went to Rajpura to attend the marriage ceremony of his cousin. It is further alleged that at about 11:00 P.M. he was sitting on a chair, the accused persons namely, Mithelesh Bhagat and Rajiv Singh started firing with an intention to kill. It is further alleged that one bullet hit the informant and they also snatched his gold chain. Accordingly, the present FIR.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.44705 of 2025(2) dt.18-07-2025 2/2 that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the allegation of firing is against Mithelesh Bhagat and not against this petitioner. No overt act has been alleged against the petitioner.
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner stating that the petitioner has one criminal antecedent.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Simri Bakhtiyarpur P.S. Case no. 23 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa, subject to the conditions as laid down under section 482(2) of the BNSS.
